Death Penalty Gambit Shocks Charlie Kirk Case

Defense lawyers for Charlie Kirk’s accused killer are trying to get the death penalty thrown out — not by challenging the evidence, but by claiming prosecutors talked too much to the media.

Quick Take

  • Tyler Robinson is charged with killing conservative activist Charlie Kirk in September 2025 at Utah Valley University.
  • Robinson’s defense team claims prosecutors went on a “media tour,” speaking to outlets like Fox News and TMZ, and asks the court to remove the death penalty as a sentencing option.
  • A judge already denied the defense’s earlier motion to disqualify the entire Utah County prosecutor’s office from the case.
  • The court found no concrete threat to a fair trial, saying standard safeguards like expanded jury pools and careful juror questioning are enough.

Defense Claims Prosecutors Broke the Rules

Robinson’s lawyers appeared in a Provo, Utah courtroom in June 2026 and argued that prosecutors had been making the rounds with media outlets. They claimed a deputy Utah County attorney discussed case evidence with reporters from TMZ and Fox News. The defense called this a violation of pretrial publicity rules and asked the judge to take the death penalty completely off the table as punishment for that alleged misconduct. [1]

The defense called removing the death penalty their “number one remedy.” That is a very aggressive legal move. In most high-profile cases, lawyers argue for a gag order, a change of venue, or more careful jury selection — not the removal of a specific punishment. Asking a judge to strip a sentencing option because of media comments is a rare and bold strategy. [3]

Judge Rejects Attempt to Remove Prosecutors

This is not the first time Robinson’s team has tried to sideline the prosecution. Earlier, they asked the court to disqualify the entire Utah County prosecutor’s office from the case. The judge denied that motion. [2] The court ruled that the office could keep building its death penalty case against Robinson. Prosecutors have formally announced they are seeking the death penalty if Robinson is convicted. [9]

On the media-contact complaint, the court found no “concrete and immediate threat” to Robinson’s right to a fair trial. The judge pointed to well-established tools — larger jury pools and thorough questioning of potential jurors — as more than enough to protect Robinson’s rights. The court refused to stay the proceedings. [6]

A Pattern of Defense Delay Tactics

The Robinson defense team has filed a series of motions that critics say are slowing the case down. Beyond trying to remove prosecutors and strip the death penalty, they have also challenged evidence and sought to close hearings to the public. Judges have pushed back on several of these moves, including a ruling that kept the preliminary hearing open to media. [5]

From a conservative standpoint, this pattern deserves scrutiny. Charlie Kirk was a well-known voice for conservative values and a founder of Turning Point USA. His accused killer is getting a full and fair legal process — as he should under the Constitution. But using procedural motions to chip away at the death penalty option, rather than contesting the facts of the case, looks more like a strategy to delay justice than to seek the truth. Utah prosecutors appear determined to move forward, and the courts so far have agreed that the process can and should continue. [4]
